Unjust Driving Ban

Ok first of all...I haven't been banned from driving :)

My brother Wayne (owner of the red gx) passed his theory test about 6 weeks ago. He went to the motor tax office in Ballymun to apply for his license, only to be told he had a 1 year driving ban from 10 years ago. Now, the history is that 10 years ago, he had a provisional license and a ford escort with a car loan and my dad to guarantee the loan. Wayne lost his job and family stuff at the time was tense, so he got kicked out and the car was given to my older brother Liam, who drove the car illegally in Waynes name and got stopped by the Gardai. Wayne moved to Sweden for 8 years and his license expired. Liam passed away a few years ago.

The motor tax office contacted the court about the discrepancy, but Wayne got a letter to say the ban would have to appear on his new license. No surprise he said no, but the Garda who started this whole thing was promoted in Dublin and is now based in Cork and is unreachable. Wayne has left loads of voicemails over the last 3 weeks and has got no reply. Solicitors would be expensive, so what do you think would be the best route here guys? With an endorsement, he would never get insured in the fto. I just think it sucks, because it wasn't his fault.

Even if you got hold of the relevant Garda its very unlikely he would have any recollection or record of something from 10 years ago.

Solicitors might be expensive but the loss of a licence is too. I would say to get some legal advice.

I've been on the wrong end of Garda (and Court) mistakes before as well but I won't clutter up your thread by taking it OT.
